1.4 References in these Terms and Conditions to “Dermaesthetica”, “we”, “us” or “our” mean Dermaesthetica Limited. References to “you”, “your”, “patient” or “client” mean the person booking or receiving our services.
2.1 Appointments may be requested through our website, online booking system, telephone, email or another booking method made available by Dermaesthetica.
2.2 An online enquiry does not guarantee an appointment. Your appointment is only confirmed once you have received confirmation from Dermaesthetica and any required consultation fee or deposit has been paid.
2.3 Patients will be required to provide their full name, contact information and any relevant medical history, medication, allergies, previous treatments or concerns.
2.4 You must ensure that all information supplied to Dermaesthetica is complete, accurate and up to date. Failure to disclose relevant medical information may affect your suitability for treatment and could increase the risk of complications.
2.5 Appointments are subject to availability. We recommend booking in advance to secure your preferred clinic, date and time.
2.6 We reserve the right to decline or postpone an appointment where we reasonably believe that treatment would be unsuitable, unsafe, clinically inappropriate or not in your best interests.
3.1 A consultation may be required before treatment can be provided.
3.2 Attending a consultation does not guarantee that a particular treatment will be offered. Treatment will only proceed where the treating practitioner considers it clinically appropriate and you have provided informed consent.
3.3 Recommendations made during a consultation will be based on the information available at that time. You must tell us about any change in your health, medication, pregnancy status or other relevant circumstances before receiving treatment.
3.4 Dermaesthetica may request identification, medical information, photographs or confirmation from another healthcare professional where reasonably required for safety or treatment planning.
3.5 Consultation fees and whether they are redeemable against treatment will be explained when you book or will be displayed on our current price list.
3.6 Where a consultation fee is redeemable, it must be redeemed within the period stated at the time of booking. Certain specialist consultations or skin-scanning appointments may not be redeemable.
4.1 You must be at least 18 years old to book or receive cosmetic botulinum toxin injections or cosmetic filler treatments.
4.2 We may request photographic identification to confirm your age.
4.3 Parental or guardian consent does not permit a person under 18 to receive a treatment that is prohibited by law.
4.4 Other treatments may also have minimum age requirements depending on the treatment, product manufacturer’s instructions and clinical assessment.
5.1 A deposit, consultation fee or booking fee may be required to secure your appointment.
5.2 The amount payable will be communicated during the booking process.
5.3 Unless otherwise agreed, your appointment will not be confirmed until the required payment has been received.
5.4 Where you attend your appointment and proceed with treatment, a treatment deposit may be deducted from the final treatment price where this has been confirmed during booking.
5.5 If you attend a consultation but decide not to proceed with treatment, any consultation service already provided remains chargeable.
5.6 Deposits and advance payments will be handled in accordance with these Terms and applicable consumer law. Any amount retained following a cancellation will be reasonable and will take account of the circumstances and losses incurred by Dermaesthetica.
6.1 If you need to cancel or reschedule your appointment, we kindly ask that you provide us with at least 24 hours’ notice.
6.2 Cancellation or rescheduling requests must be made by contacting the clinic directly by telephone or email. A cancellation is not confirmed until it has been acknowledged by Dermaesthetica.
6.3 Failure to provide sufficient notice may result in a reasonable cancellation fee, the loss of some or all of your deposit, or a requirement to pay a further deposit before another appointment can be booked.
6.4 Any cancellation charge or retained deposit will reflect the nature of the appointment, the notice provided, the costs incurred and whether the appointment could reasonably be filled by another patient.
6.5 Where a course, package or membership appointment is cancelled without sufficient notice, the appointment may be treated as used where this was clearly explained when the course, package or membership was purchased.
6.6 We understand that genuine emergencies and exceptional circumstances can occur. Any waiver of a cancellation fee will be considered at our discretion and on a case-by-case basis.
6.7 If Dermaesthetica needs to cancel or rearrange your appointment, we will attempt to provide as much notice as reasonably possible and offer an alternative appointment.
6.8 Dermaesthetica will not be responsible for reasonable travel, accommodation, childcare, loss of earnings or other indirect expenses arising from the cancellation or rescheduling of an appointment, except where liability cannot legally be excluded.
7.1 We understand that unforeseen circumstances may cause you to arrive late for your appointment.
7.2 Late arrivals may result in a shortened consultation or treatment time to avoid inconvenience to other patients.
7.3 Where there is insufficient time to provide treatment safely and professionally, the appointment may need to be rescheduled.
7.4 A rescheduled appointment resulting from a late arrival may be treated as a late cancellation, and a reasonable fee or further deposit may be required.
7.5 If you anticipate being late, please contact the clinic as soon as possible.
8.1 If you fail to attend a scheduled appointment without providing notice, you may be charged a reasonable missed-appointment fee or lose the deposit paid.
8.2 You may be required to pay the full cost of the missed appointment where that amount reasonably reflects the loss suffered by Dermaesthetica.
8.3 Repeat missed appointments may result in restrictions being placed on your ability to make future bookings.
8.4 We may require full advance payment before accepting further appointments from patients with repeated missed appointments or late cancellations.
9.1 Payment for appointments, treatments and services provided by Dermaesthetica is due at the time of your visit unless another arrangement has been agreed in writing.
9.2 We accept the payment methods displayed at the clinic or through our approved booking and payment providers.
9.3 We do not accept personal cheques unless this has been expressly agreed in advance.
9.4 Treatment prices will be communicated at the time of booking, during your consultation or through our current published price list.
9.5 Prices may vary between clinic locations, practitioners, products, treatment areas and individual treatment plans.
9.6 A quotation or treatment plan is based on the information available at the time it is issued. Where your treatment requirements change, we will explain any additional cost before proceeding.
9.7 Dermaesthetica reserves the right to change its prices. Price changes will not normally affect an appointment that has already been confirmed and paid for unless the treatment plan is subsequently changed with your agreement.
9.8 You must raise any payment query as soon as reasonably possible.
10.1 Courses, treatment packages, memberships, vouchers and promotional offers may be subject to additional conditions provided at the time of purchase.
10.2 Any stated expiry date, treatment interval, usage restriction or clinic limitation will form part of the agreement.
10.3 Courses and packages are personal to the named patient and may not be transferred unless Dermaesthetica agrees otherwise in writing.
10.4 Promotional offers cannot be exchanged for cash and cannot normally be combined with another offer unless expressly stated.
10.5 If there is a conflict between these Terms and specific written terms applying to a package, membership or promotion, the specific terms will take priority in relation to that package, membership or promotion.
11.1 Before receiving treatment, you will be given appropriate information about the proposed procedure, expected benefits, material risks, alternatives, likely recovery and aftercare.
11.2 You will be asked to provide informed consent before treatment begins.
11.3 You may withdraw your consent before treatment takes place. However, consultation fees, products specifically prepared for you and reasonable costs already incurred may remain payable.
11.4 Dermaesthetica reserves the right to refuse, stop or postpone treatment where:
treatment is not considered clinically appropriate;
information relevant to your safety has not been disclosed;
consent cannot be properly obtained;
you appear to be under the influence of alcohol or drugs;
your behaviour is abusive, threatening or inappropriate;
treatment would breach professional standards, manufacturer guidance or applicable law; or
the treating practitioner believes proceeding would not be in your best interests.
12.1 Dermaesthetica will provide its services with reasonable care and skill.
12.2 Aesthetic and skin-treatment results vary between individuals. Results may be influenced by age, health, lifestyle, skin condition, anatomy, medication, healing response and compliance with aftercare instructions.
12.3 Images, testimonials, treatment descriptions and estimated results shown on our website or social media are illustrative and do not guarantee that you will achieve the same outcome.
12.4 No specific result, duration or level of improvement can be guaranteed.
12.5 Some treatments require a course of appointments, maintenance treatments or follow-up care to achieve or maintain the intended result.
13.1 All aesthetic and skin treatments carry potential risks, side effects and complications.
13.2 Relevant risks will be discussed with you before treatment. You are responsible for asking questions and telling your practitioner about anything you do not understand.
13.3 You must follow all pre-treatment and aftercare instructions provided by Dermaesthetica.
13.4 You must contact Dermaesthetica promptly if you experience an unexpected reaction, worsening symptoms or concerns following treatment.
13.5 Where symptoms appear serious or urgent, you should seek immediate medical assistance through the appropriate emergency or healthcare service rather than waiting for a response from the clinic.
13.6 Dermaesthetica is not responsible for complications caused or materially contributed to by inaccurate information, undisclosed medical conditions, failure to follow instructions, interference with the treated area or treatment received elsewhere.
14.1 Some treatments include or recommend a review appointment.
14.2 You must attend any review within the timeframe advised by your practitioner.
14.3 A review appointment does not automatically include additional treatment or products without charge.
14.4 Additional treatment will only be provided where clinically appropriate. Charges may apply and will be explained before further treatment is carried out.
14.5 Failure to attend within the recommended review period may affect our ability to assess your result or provide additional treatment.
15.1 Clinical photographs may be taken where reasonably required for assessment, treatment planning, patient safety and maintaining an accurate medical record.
15.2 Clinical photographs form part of your confidential treatment record and will be handled in accordance with our Privacy Policy.
15.3 Photographs or videos will not be used for marketing, education, social media or promotional purposes without separate appropriate consent.
15.4 You may withdraw marketing consent for future use by contacting Dermaesthetica. Withdrawal will not affect material that has already been lawfully published or used before consent was withdrawn where removal is not reasonably possible.
16.1 Dermaesthetica collects and processes personal information, including health information, in connection with consultations, treatment, bookings, payments and aftercare.
16.2 Your personal information will be handled in accordance with our Privacy Policy and applicable data-protection law.
16.3 You are responsible for informing us if your name, address, contact details, medical history or other relevant information changes.
16.4 By using a third-party booking or payment provider, you may also be subject to that provider’s privacy policy and terms.
17.1 Dermaesthetica operates a zero-tolerance approach to abusive, discriminatory, threatening, aggressive or inappropriate behaviour towards staff, practitioners, contractors and other patients.
17.2 We may refuse service, end an appointment or restrict future bookings where behaviour is considered unacceptable.
17.3 Where an appointment is ended because of a patient’s behaviour, reasonable fees may remain payable for time, products or services already provided.
18.1 We aim to provide a high standard of treatment and patient care.
18.2 If you are dissatisfied with any aspect of our service, please contact Dermaesthetica as soon as reasonably possible so that we can investigate your concerns.
18.3 Complaints should include your name, contact details, appointment date, clinic location and a clear description of your concern.
18.4 We may ask you to attend an assessment or provide further information before we can fully respond.
18.5 Raising a complaint does not affect your statutory rights.
19.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
19.2 Nothing in these Terms affects your statutory consumer rights.
19.3 Subject to clause 19.1, Dermaesthetica will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a person acting for commercial purposes.
19.4 We are not responsible for loss or damage caused by your failure to provide accurate information, follow clinical advice or comply with pre-treatment or aftercare instructions.
